Ezekben az esetekben <strong>egyr\u00e9szt megnyilv\u00e1nul v\u00e9grehajt\u00e1st k\u00e9r\u0151 rendelkez\u00e9si joga<\/strong> (ha a v\u00e9grehajt\u00e1st k\u00e9r\u0151 nem \u00e9rt egyet a tart\u00e1sd\u00edjra, munkab\u00e9rre vagy vele egy tekintet al\u00e1 es\u0151 k\u00f6vetel\u00e9sre enged\u00e9lyezett r\u00e9szletfizet\u00e9ssel, vagy ha a mag\u00e1nszem\u00e9ly v\u00e9grehajt\u00e1st k\u00e9r\u0151 \u00fagy nyilatkozik, hogy l\u00e9tfenntart\u00e1s\u00e1t vesz\u00e9lyezteti a r\u00e9szletfizet\u00e9s), <strong>m\u00e1sr\u00e9szt olyan k\u00f6r\u00fclm\u00e9nyek k\u00f6vetkeznek be, melyek sz\u00fcks\u00e9gszer\u0171en vezetnek a r\u00e9szletfizet\u00e9s megsz\u0171n\u00e9s\u00e9hez<\/strong> (gazd\u00e1lkod\u00f3 szervezet v\u00e9grehajt\u00e1st k\u00e9r\u0151 ellen pedig cs\u0151d-, felsz\u00e1mol\u00e1si vagy v\u00e9grehajt\u00e1si elj\u00e1r\u00e1s van folyamatban).<\/p>\n<p style=\"text-align: justify;\">A k\u00f6vetkez\u0151 bekezd\u00e9s (6) is korl\u00e1toz\u00e1st tartalmaz. B\u00e1r el\u00e9g ritk\u00e1n el\u0151fordul\u00f3 esetr\u0151l van sz\u00f3, \u00e1ll\u00e1spontom szerint \u2013 egyez\u0151en a r\u00e9szletes t\u00f6rv\u00e9nyi indokl\u00e1sban le\u00edrtakkal- vitathat\u00f3 a rendelkez\u00e9s l\u00e9tjogosults\u00e1ga, hiszen, ha megfizette volna a lej\u00e1rt r\u00e9szleteket az ad\u00f3s, nem lenne v\u00e9grehajt\u00e1s ellene. \u00cdgy most, ugyanazon r\u00e9szletfizet\u00e9si lehet\u0151s\u00e9get kapja meg, amit egy\u00e9bk\u00e9nt (v\u00e9grehajt\u00e1si elj\u00e1r\u00e1s el\u0151tt) sem teljes\u00edtett. A r\u00e9szletfizet\u00e9s meg\u00e1llap\u00edt\u00e1s\u00e1nak l\u00e9nyeges krit\u00e9riuma tov\u00e1bb\u00e1 az is, hogy ad\u00f3s a szerz\u0151d\u00e9s szerinti <em>lej\u00e1rt r\u00e9szleteket<\/em> megfizesse, ennek t\u00e9nye <em>el\u0151felt\u00e9tele<\/em> a r\u00e9szletfizet\u00e9s meg\u00e1llap\u00edt\u00e1s\u00e1nak.<\/p>\n<p style=\"text-align: justify;\">L\u00e9nyeg\u00e9ben ad\u00f3s mozg\u00e1ster\u00e9t sz\u0171k\u00edti a Vht. azon rendelkez\u00e9se is, hogy <strong>r\u00e9szletfizet\u00e9s csak valamennyi \u00fcgyben adhat\u00f3<\/strong>. Mindent vagy semmit, mondhatn\u00e1nk, hiszen ad\u00f3snak meg kell birk\u00f3znia az \u00f6sszes \u00fcgy\u00e9nek r\u00e9szletfizet\u00e9si terh\u00e9vel, hogy elker\u00fclj\u00f6n s\u00falyosabb k\u00e9nyszercselekm\u00e9nyeket. <strong>E rendelkez\u00e9snek kifejezetten hitelez\u0151v\u00e9delmi indokai vannak<\/strong>, hiszen az ad\u00f3s a v\u00e9grehajt\u00e1st k\u00e9r\u0151 hozz\u00e1j\u00e1rul\u00e1sa n\u00e9lk\u00fcl is kaphat r\u00e9szletfizet\u00e9si kedvezm\u00e9nyt a Vht. 52\/A-B. \u00a7-a alapj\u00e1n, amelyet k\u00f6vet\u0151en az elj\u00e1r\u00e1s sz\u00fcnetel, \u00e9s a v\u00e9grehajt\u00f3 tov\u00e1bbi int\u00e9zked\u00e9st nem tehet az \u00fcgyben, \u00edgy, ha az ad\u00f3s t\u00f6bbi v\u00e9grehajt\u00e1si \u00fcgy\u00e9ben id\u0151k\u00f6zben a vagyont\u00e1rgyai \u00e9rt\u00e9kes\u00edt\u00e9sre ker\u00fclnek, a r\u00e9szletfizet\u00e9ssel \u00e9rintett \u00fcgy v\u00e9grehajt\u00e1st k\u00e9r\u0151j\u00e9nek k\u00f6vetel\u00e9se nem nyer kiel\u00e9g\u00edt\u00e9st, \u00e9s az ezt k\u00f6vet\u0151 r\u00e9szletek teljes\u00edt\u00e9se is b\u00e1rmikor abbamaradhat.<\/p>\n<p style=\"text-align: justify;\"><strong>A r\u00e9szletfizet\u00e9s korl\u00e1toz\u00e1s\u00e1nak egyik legink\u00e1bb szembet\u0171n\u0151 megnyilv\u00e1nul\u00e1sai maga a jogszab\u00e1lyban r\u00f6gz\u00edtett id\u0151 \u00e9s \u00e9rt\u00e9khat\u00e1rok<\/strong>, \u00edgy a kis \u00f6sszeg\u0171 k\u00f6vetel\u00e9sek 500.000,-Ft (z\u00e1logjog megl\u00e9te eset\u00e9n 1.000.000,- Ft) \u00e9rt\u00e9khat\u00e1ra, a r\u00e9szletfizet\u00e9s enged\u00e9lyez\u00e9s\u00e9hez kapcsolt 2.000.000,- Ft-os \u00e9rt\u00e9khat\u00e1r (z\u00e1logjog megl\u00e9te eset\u00e9n 3.000.000,- Ft) valamint a r\u00e9szletfizet\u00e9s meg\u00e1llap\u00edt\u00e1s\u00e1nak id\u0151tartamai \u2013 mely ut\u00f3bbi korl\u00e1toz\u00e1s a v\u00e9grehajt\u00e1st k\u00e9r\u0151 hozz\u00e1j\u00e1rul\u00e1sa eset\u00e9n ad\u00f3s r\u00e9sz\u00e9re hosszabb r\u00e9szletfizet\u00e9si id\u0151tartam meghat\u00e1roz\u00e1s\u00e1val fel\u00fcl\u00edrhat\u00f3.<\/p>\n<p style=\"text-align: justify;\"><strong>Tov\u00e1bbi krit\u00e9riumk\u00e9nt tesz eml\u00edt\u00e9st a Vht. a r\u00e9szletfizet\u00e9s enged\u00e9lyez\u00e9s\u00e9nek gyakoris\u00e1g\u00e1r\u00f3l.<\/strong> A r\u00e9szletfizet\u00e9s, mint fizet\u00e9si kedvezm\u00e9ny a v\u00e9grehajt\u00e1si elj\u00e1r\u00e1sban (v\u00e9grehajt\u00f3 \u00e1ltal) egyszer adhat\u00f3, annak elmulaszt\u00e1sa eset\u00e9n ad\u00f3s r\u00e9sz\u00e9re v\u00e9grehajt\u00f3 r\u00e9szletfizet\u00e9st m\u00e1r nem \u00e1llap\u00edthat meg. Ez el\u00e9g szigor\u00fa rendelkez\u00e9s, hiszen, ha ad\u00f3s t\u00f6bb \u00fcgyben is r\u00e9szletfizet\u00e9ssel teljes\u00edt, s egyetlen \u00fcgy\u00e9ben is mulaszt, akkor valamennyi m\u00e1s \u00fcgy\u00e9ben meg\u00e1llap\u00edtott r\u00e9szletfizet\u00e9s is megsz\u0171nik? Elvileg igen.
